Celgene Decision

The Board issued its decision in the Thalidomide case, in which the Board Staff were seeking an order for the production of data. The Board ruled that they do have jurisdiction over sales of Thalidomide, back to the laid-open patent date in January 1995. Celgene Corporation argued that the Board did not have jurisdiction since its sales were made from the US under a Special Access Program, and pre-patent. Note that this decision was published in today’s front page of the Globe and Mail.
